Financial institutions – their practices, products, and processes – are increasingly under scrutiny from regulators, shareholders, and policymakers. Analysis Group consults extensively to these institutions in both litigation and non-litigation contexts.

We have developed expertise in several specific areas. For example, we have extensive experience with litigation involving the analysis of bankruptcy, including many complex and high-profile litigations; in analyzing issues of fraud, malpractice, and anticompetitive behavior, from review of accounting records and other financial documents to estimation of damages and restitution assessment in antitrust matters; and in the analysis of complex derivative instruments, including portfolio analysis of a variety of structured instruments.

In valuing financial products and practices, we combine thorough knowledge of the underlying value of individual instruments and deep familiarity with financial institution markets and practices. For mutual fund and financial services companies, pension funds, brokerages, investment banks, market makers, and other financial institutions, we have analyzed competitive issues, evaluated portfolio risk, and assessed investment strategies.

Our staff and affiliates are expert in the structure and workings of private equity firms.  These firms, along with venture capital firms and hedge funds, undertake highly leveraged investments, often in bankrupt companies. When credit markets contract, their transactions may be shelved, resulting in litigation.

The unique structure of these organizations – for example, private equity firms often share large common positions – makes a thorough understanding of their operations and mechanisms valuable to participants involved bankruptcy litigations. We also provide expert witness testimony, frequently in the context of high-stakes litigation.

Our experience with the banking industry includes investment banks, savings and loans, and commercial lenders.  We have provided analysis of lending policies and underwriting practices, research into the cause and consequences of bank failure, and examination of regulations and tax laws.

We provide research, analysis, and expert testimony on many insurance industry litigation matters, often involving claims by regulators or class plaintiffs. We have also provided financial analysis, including valuation.

We have worked on behalf of payment card companies in antitrust litigations, analyzing competitive factors such as technological innovation, advertising, and new card programs.
